These Terms of Service (“Terms”) form a binding agreement between you and MyVibeCoffee (“MyVibeCoffee”, “we”, “our”, or “us”) governing your use of our website, services, and applications (collectively, the “Service”). By accessing or using the Service, by creating an account, or by otherwise interacting with the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy.
If you do not agree to these Terms, you must not use the Service. If you are accessing the Service on behalf of another person or organization, you represent that you have the authority to bind that person or organization to these Terms.
MyVibeCoffee is a community platform built for Hong Kong specialty coffee enthusiasts. Through the Service, you can record café visits and brews as “check-ins”, write structured tasting notes that capture flavor, brew parameters, equipment, and beans, organize and join café team-ups (looking-for-group or “LFG”) with other community members, follow other users, react to and comment on content, and receive personalized recommendations for cafés, beans, and equipment based on your tastes and history.
The Service is provided as a community tool to help coffee enthusiasts in Hong Kong discover, document, and share their interest in specialty coffee. Some features may be added, modified, or removed over time as the Service evolves. Where reasonable, we will provide notice of material changes through the Service.
To access most features of the Service, you must register an account. When registering, you agree to provide accurate, current, and complete information, and to keep your account information up to date. You are responsible for maintaining the confidentiality of your authentication credentials, including any third-party identity provider credentials (such as Google) you use to sign in, and for all activity that occurs under your account.
You must be at least 13 years of age (or 16 years of age in jurisdictions where that higher threshold applies, including parts of the European Economic Area) to use the Service. By creating an account, you represent that you meet this age requirement. We may suspend or terminate accounts that we reasonably believe do not meet the age requirement.
You agree to notify us promptly at the contact address in Section 14 if you become aware of any unauthorized use of your account or any other breach of security.
You agree to use the Service in a manner that respects other community members and complies with these Terms. Without limitation, you agree that you will not:
We may, at our discretion and without prior notice, remove content or suspend or terminate accounts that violate these Terms or that we reasonably believe present a risk to the community or to the Service.
You retain ownership of the content you create and submit through the Service, including check-ins, tasting notes, comments, posts, photos, and team-up descriptions (“User Content”). You are solely responsible for the User Content you submit and for ensuring you have all necessary rights to submit it.
By submitting User Content, you grant MyVibeCoffee a worldwide, non-exclusive, royalty-free, transferable license to host, store, reproduce, modify (for technical purposes such as resizing images), display, distribute, and otherwise use the User Content solely for the purpose of operating, providing, and promoting the Service. This license terminates when you delete the User Content from the Service or close your account, except where the User Content has been shared with other users (in which case anonymized references may persist as described in our Privacy Policy).
We reserve the right, but are not obligated, to review, monitor, or remove User Content at our discretion, including content that we believe violates these Terms or is otherwise objectionable.
The Service, including its design, layout, brand, logos, source code, original written content, and curated databases, is owned by MyVibeCoffee or its licensors and is protected by copyright, trademark, and other intellectual property laws. Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, or create derivative works of any portion of the Service without our prior written consent.
The license you grant to MyVibeCoffee in Section 5 with respect to your User Content is a non-exclusive license. You retain all underlying rights in your User Content. Other users’ use of your User Content within the Service is subject to these Terms.
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
Information about cafés, beans, equipment, opening hours, prices, and other third-party content is provided for community reference only. We do not warrant the accuracy, completeness, or timeliness of such information. Café details may change, and you should verify critical information directly with the café before relying on it.
User-generated content reflects the views of the contributing users and not those of MyVibeCoffee. We do not endorse and are not responsible for User Content. You acknowledge that any reliance on User Content is at your own risk.
Café team-ups and other in-person gatherings facilitated by the Service are organized between users at their own discretion and risk. MyVibeCoffee is not a party to any meeting, transaction, or arrangement between users. You are solely responsible for your own safety, conduct, and decisions when meeting other users in person or otherwise interacting with them off-platform.
To the maximum extent permitted by Hong Kong law, in no event shall MyVibeCoffee, its officers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use of (or inability to use) the Service, any User Content, or any conduct or content of any third party on the Service.
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or in connection with the Service shall not exceed the greater of (a) the amount you have paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred Hong Kong dollars (HKD 100). Some jurisdictions do not allow certain limitations of liability, so portions of this limitation may not apply to you.
You agree to indemnify, defend, and hold harmless MyVibeCoffee and its officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service in breach of these Terms; (b) your User Content; (c) your violation of any applicable law or third-party right; or (d) any dispute between you and another user.
You may terminate your account at any time through your account settings or by contacting us at the address in Section 14. Account deletion is processed as described in our Privacy Policy.
We may suspend or terminate your access to the Service, in whole or in part, with or without notice, if we reasonably believe you have violated these Terms, if your use poses a risk to other users or to the Service, or if we are required to do so by law. Upon termination, the licenses granted by you to us under these Terms shall continue with respect to User Content that has already been shared with other users, in anonymized form where applicable.
These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People’s Republic of China, without regard to conflict-of-laws principles.
You agree that the courts of the Hong Kong Special Administrative Region shall have exclusive jurisdiction over any claim or dispute arising out of or in connection with these Terms or the Service. Before commencing formal legal proceedings, you agree to make a good-faith effort to resolve the dispute informally by contacting us at the address in Section 14 with a description of the claim and your requested relief.
We may update these Terms from time to time. When we make material changes, we will update the “Last Updated” date at the top of this page and provide notice through the Service or by other reasonable means. By continuing to use the Service after the effective date of an update, you agree to the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and may close your account.
